Elder Law Attorneys: Planning Ahead With Confidence

Elder law attorneys help older adults and families address legal, financial, and care-planning questions that often arise with aging. They may assist with wills and trusts, durable and medical powers of attorney, advance directives, public benefits such as Medicaid, long-term-care planning, probate, guardianship, and protection from financial exploitation.

WHEN TO CONSIDER LEGAL HELP

• Before a health crisis, while your loved one can clearly explain their wishes.

• When reviewing or creating powers of attorney, advance directives, wills, or trusts.

• When planning for long-term care or applying for public benefits.

• When there are questions about guardianship, decision-making authority, probate, or possible exploitation.

QUESTIONS TO ASK AN ATTORNEY

• How much of your practice focuses on elder law and Texas law?

• Who is the attorney's client: the older adult, another family member, or both?

• What documents or financial records should we bring?

• What are the consultation and ongoing fees?

• Are there less restrictive alternatives to guardianship that should be considered?

BEFORE THE APPOINTMENT

Bring current estate-planning documents, insurance information, a medication and care summary, a list of assets and debts, and the names of people involved in caregiving or financial decisions. Never sign a document you do not understand.
